Terms of Service

Welcome to Lockd In. These Terms of Service ("Terms") govern your access to and use of the Lockd In mobile application and related services (collectively, the "Service") operated by Lockd In ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Account Registration and Responsibilities
To use the Service, you must create an account by providing accurate and complete information, including your name, email address, and a password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Keeping your account information accurate and up to date
We reserve the right to suspend or terminate accounts that contain false or misleading information.
3. Crew Membership and Conduct
Lockd In enables users to form small groups ("Crews") for mutual accountability. As a Crew member, you agree to:
- Interact respectfully with all Crew members
- Participate in good faith in Crew activities and check-ins
- Abide by Crew rules established by the Crew admin
- Comply with our Community Guidelines
4. Goals and Accountability System
The Service allows you to set personal goals within your Crew, track progress through check-ins, and hold each other accountable through 6-week goal cycles. You acknowledge that:
- Goal outcomes are your sole responsibility
- Lockd In does not guarantee any particular results from using the accountability system
- Check-ins and progress updates should be honest and accurate
5. Financial Stakes and Payments
IMPORTANT: Please read this section carefully. It outlines the limitations of Lockd In's role in financial transactions between users and Stripe.
5.1 Stripe Account Connection
Lockd In allows users to connect their own Stripe accounts to facilitate crew-related fines, penalties, and payments as part of the accountability system. By connecting your Stripe account, you acknowledge and agree to the following:
5.2 Lockd In's Limited Role
- Lockd In solely facilitates the technical connection between your Stripe account and the Service
- Lockd In does NOT hold, manage, process, or take any responsibility for funds in your Stripe account
- Lockd In does NOT act as a financial institution, payment processor, or money transmitter
- All payment transactions occur directly between you and Stripe, governed by Stripe's terms of service and privacy policy
5.3 User Responsibility
You are solely responsible for:
- Managing your Stripe account, including payment methods, security settings, and account credentials
- Any and all fees, charges, or costs associated with your Stripe account
- Reviewing and understanding Stripe's terms of service, fees, and policies
- Ensuring sufficient funds or valid payment methods are available for any commitments made through the Service
- Resolving any payment disputes directly with Stripe
5.4 No Liability for Financial Losses
To the maximum extent permitted by law, the owners, developers, operators, and affiliates of Lockd In accept NO liability whatsoever for:
- Any financial losses arising from the use of your Stripe account in connection with the Service
- Unauthorised charges, payment failures, or processing errors
- Disputes between Crew members regarding financial stakes or payments
- Any fees, penalties, or costs imposed by Stripe
- Loss of funds, chargebacks, or refund disputes
- Any other financial issues arising from the use of Stripe in connection with the Service
5.5 Payment Disputes
All payment disputes are strictly between you and Stripe. Lockd In will not mediate, arbitrate, or resolve any financial disputes. If you experience issues with payments, you must contact Stripe directly through their support channels.
6. User-Generated Content
The Service allows you to create and share content, including posts, photos, check-ins, and comments ("User Content"). By posting User Content, you:
- Retain ownership of your User Content
- Grant Lockd In a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your User Content solely for the purpose of operating and improving the Service
- Represent that you have the right to share the content and that it does not violate any third-party rights
- Acknowledge that User Content shared within a Crew is visible to other Crew members
We reserve the right to remove any User Content that violates these Terms or our Community Guidelines.
7. Intellectual Property
The Service, including its design, features, code, graphics, logos, and trademarks, is owned by Lockd In and protected by intellectual property laws. You may not:
- Copy, modify, or distribute any part of the Service without our prior written consent
- Reverse engineer, decompile, or disassemble the Service
- Use our trademarks or branding without authorisation
- Create derivative works based on the Service
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied
- Lockd In does not warrant that the Service will be uninterrupted, error-free, or secure
- Lockd In shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to Lockd In in the twelve (12) months preceding the claim, or AUD $100, whichever is less
9. Termination
We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or our Community Guidelines
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Requests by law enforcement or government agencies
You may delete your account at any time by contacting us at Support@lockdin.com.au. Upon termination, your right to use the Service will immediately cease, and your data will be handled in accordance with our Privacy Policy and Data Deletion Policy.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
11. Dispute Resolution
In the event of any dispute arising from these Terms or your use of the Service, you agree to first attempt to resolve the matter informally by contacting us at Support@lockdin.com.au. If the dispute cannot be resolved informally within 30 days, either party may pursue formal resolution through the courts of Australia in accordance with Section 10.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Effective Date" at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
